SPRING, TX — A homeowner in his 80s shot and killed a man inside his Spring-area home Tuesday morning, Nov. 3, according to the Harris County Sheriff’s Office.
Sgt. Sidney Miller of the sheriff’s office Homicide unit briefed media in the 15700 block of Misty Hollow Drive, near Stuebner Airline and Cypresswood Drive. In a video posted to its official Facebook page, the sheriff’s office said a male homeowner arrived at his residence and was confronted by an unknown male. The shooting happened sometime after 8 a.m., as reported by KHOU.
Harris County Precinct 4 deputy constables were sent to the home on a report of a firearm discharge. They found the homeowner outside. He told deputies he had shot someone inside his home. The man was pronounced dead at the scene.
According to sheriff’s office homicide investigators, the homeowner reportedly told them he fired his weapon to stop the man from stealing his property. Neither the sheriff’s office post nor the KHOU report named either man.
The homeowner was taken to a local hospital as a precaution. He was not physically injured and is expected to be OK.

Sgt. Miller said investigators are canvassing the neighborhood for surveillance video, speaking with witnesses, and plan to interview the homeowner and take a formal statement. Once the investigation is complete, the case goes to the Harris County District Attorney’s Office, which will decide whether any charges are appropriate. No charging decision has been announced.
Deadly force is justified only against an imminent threat of death or serious bodily harm. The sheriff’s office says this homeowner was confronted, but nothing released so far describes what that confrontation involved. That gap is what the video canvass, the witness interviews and his formal statement will have to fill. The mindset I train around does not change with the circumstances: the gun is for stopping a threat to a life, not for stopping a theft.
